News Updates August 2007 ......
Delusion has won a federal trademark dispute against actor Greg Evigan filed with the United States Patent and Trademark Offices in 2003 over use of the name Dillusion as a music group. Delusion are awaiting the announcement of this decision by the USPTO now only weeks away. The case is clearly decided and Evigan has already ceased use of the name Dillusion. This battle over these two names has been on-going since 2003 and has involved the questionable actions of not only Evigan, but MTV and the Osbournes Show.

It must be understood that a band name is a business name and in business their are laws which regulate the commercial use of names called marks or brands. No two similar names can exist within the same industry that will interfere or cause confusion for the other. There are necessary steps that must be taken to secure rights to use of a name such as searching for an unused name in each geographic region that will be marketed, commercially using the name on products to establish a first-use, and confronting other known uses by others of the name anytime thereafter. Delusion founder Phil Carnes performed these necessary steps the beginning of 1996 and continued to add to the evidences of Delusion's name use from that point on through commercial releases in 1996,1997,1998,1999, and 2003 which established the groups name in over two countries around the world. The group Dillusion from California featured Greg Evigan's son Jason and it is still unclear to what exent Greg Evigan's role was in the group. The began as a club band in their region of California somewhere between 1997-1999 having only commercial exposure nationally on an episode of the Osbourne Television Show and Osbournes Show Christmas CD in 2002-2003. It was that national exposure which caused confusion and conflicts for the group Delusion resulting in their pursuit of Dillusion to cease and desist.

To summarize the events, actor Greg Evigan attempted to file a trademark in his name for the band name Dillusion. That band appeared on national televison on the Osbourne's show and defamed the good name of the group Delusion by displaying unprofessional conduct and in the fact that no visual representation of the band name was provided . As both names Delusion and Dillusion are near phonetically exact all sorts of confusion and conflicts resulted. Greg Evigan was notified in 2003 to cease and desist along with strong evidences of Delusions first-use establishment. He instead continued to attempt to get the trademark which would basically steal the rights from Delusion. MTV was notified of the same and asked to cease airing that episode which they claimed they would investigate. They did nothing and instead aired that episode dozens of times over a period of just months continuing to cause conflicts for Delusion. The Osbournes were sent notice but failed to ever reply to this matter. This resulted in an on-going three year battle with the USPTO over opposition of Evigans trademark application which cost the label its already small advertising budget for the Delusion release instead on legal fees and wasted time. During that time Dillusion continued commercially using that name on the Osbournes Show Christmas CD and later on the release of the shows 2nd season DVD. Despite the request by Delusion that the episode containing Dillusion not be included in the DVD release, it was released anyway. Evigan who has never been able to provide any substantial evidence to establish a first-use prior to Delusion's and attempted to change his claim of first-use during the interrogatories finally conceded to cease and desist in late 2005, whereupon the website and domain name for Dillusion have been removed. It is now a matter of weeks before the USPTO makes its official ruling which will be in favor of Delusion.

It is evident in this matter that the infringing parties of Evigan, MTV, and the Osbourne's Show all were knowingly aware their actions were potentially damaging to the music group Delusion. Despite this they continued to cause conflict for the group which resulted in the forced early release of the studio album to fulfill trademark use deadlines which would otherwise not have been of such timely concern and the loss of the advertising budget for that release which resulted in sales that were less than half what was projected and possible. For a period of one-two years Delusion fans and Dillusion fans have been confused about which band was which and attached to which music style. This continued throughout the time that Delusion's CD product had been internationally released through several distributers covering twenty-eight countries. This was further complicated by the necessary action of not promoting the group during the period of opposition with the USPTO. Without question this trademark event hurt the debut CD release, not on a grand scale of units sold but possible as much as 10,000 units. Many people missed out on owning this release due to the loss of advertising. This event as well placed great emotional strain on Delusion founder Phil Carnes whose rights he established legitimately were threatened to be taken away by Evigans granting of a trademark for Dillusion, which he continued to pursue to the end.

News Updates 01-25-04 ......
The new Delusion cd began shipping nationally to stores in the United States on 12-28-03. So far feedback has been positive in only the first month. The cd will begin shipping to stores internationally on 01-28-04. The website's Listening Room has been updated with MP3 and RealMedia song samples from the new cd release. Check out the bands music video for "I'll Fly" in streaming RealMedia format while you're in the Listening Room. Ravenhurst Records are currently negotiating a distribution agreement with Nightmare Records to further the reach of Delusion's new cd release and promotional cds are now being sent out for reviews and airpaly.

News Updates 11-18-03 ......
The time has come ..... The conquest nears ..... On November 28 , 2003 Ravenhurst Records will release the new Delusion album , titled The Tragedy of Regrets. The long anticipated CD release is expected to cross several genres with rock and metal fans. A rock and metal experience of mood , melody , and emotion for all to experience. The album was recorded over several years at Highview Studios with Drew Mazurek , whose credits include Gwar , Nothingface , Linkin' Park , Dog Fashion Disco , Souls at Zero , Click , Desolate Angel , etc. The new album which was intended to be a twelve song release was scaled back to eleven songs due to scheduling difficulties. The band however chose to include the lyrics to this missing twelveth song inside the cd as it was symbolic to the closing of the album concept. The album will be available worldwide through various retail store locations and online merchants. News Updates 09-15-03 ......

Attorneys for Delusion have filed opposition to a United States Trademark application filed by a California band attempting to secure the name Dillusion. Delusion's claim for opposition is based on earliest establishment , similarity, and exact pronounciation of the two band names. Considerabe confusion has been caused for Delusion by this California bands use of the name Dillusion. Their appearance on an episode of The Osbournes Show, aired repeatedly on the MTV Network, may be a major factor involved in further legalities. Due to the red tape and politics involved , the opposition could take anywere from a few weeks to a year. More to follow ......

News Updates 08-19-03 ......

Delusion have finally completed mixing their new album with engineer Drew Mazurek at Highview Studios. The eleven song album will be mastered later this month and a tentative release date has been set for October 1 , 2003. On the business end , Delusion have negotiated a deal with the Ravenhurst Record label , who will now be releasing the bands just completed album on CD and their music video on VHS. The album will be available in most retail locations , internet music sites , and mail order companies.

Representatives for Delusion and the bands attorneys are preparing to take serious actions to protect the bands rights in the name Delusion, which are being threatened.

Drew Mazurek has gained quite a name for himself mixing recordings for bands such as Linkin' Park , Dog Fashion Disco , Gwar , Click , Nothingface , and many more.

News Updates 04-02-03 ......

Delusion's new music video for "I'll Fly" has dominated the Mpulse Internet Charts. The song which entered the charts two weeks ago at number 480 , reached number one this week and continues to fluctuate within the Top Ten Hard Rock and Metal songs. Delusion are currently waiting to return to Highview Studios to finish the final mixes with Producer / Mixing Engineer Drew Mazurek , who has been away finishing mixes for the band Linkin Park. Delusion's new album The Tragedy of Regret will be completed this year for international release. Pre-orders are being accepted through HMV , a major distributor for Canada and the U.K. Delusion will likely produce another music video as well for this album and the band members have been discussing which song they may use for this video. News Updates 03-11-03 ......

Delusion's first music video has been produced by FutureMedia and InFlight Video. Visit the listening room to see the video for " I'll Fly " and hear other song samples. A fourteen minute video presentation will be released which includes a brief biography , the music video , and a behind the scenes on the making of the " I'll Fly " video. Look for the video presentation to become available when the cd album The Tragedy of Regret is released. The video was filmed in Baltimore , MD in the fall of 2002 and was directed by Delusion guitarist Phil Carnes. The production of the video took eight months to complete and included casting actors , designing costumes , building sets , and more .....

News Updates 02-07-03 ......

Delusion guitarist Phil Carnes made a statement today in regards to the recent developments regarding the infringement of the name Delusion. He was quoted saying " This is a very difficult matter for which I have now heard the phrase 'opening Pandora's Box' quite alot in the past few weeks. The problem exists because the laws and terms over the use of a name in business are usually never considered by bands who take a name and use it. The same exists probably throughout businesses in general who do not do extensive searches for names in use , conflicts , similarities , confusions , etc. before claiming a name as their own. With common laws offering ways to establish a name legally , but yet providing no means of documenting these uses by database or other means , it becomes a necessity to extensively search for a name free of conflict. Due to an incident that has recently occurred , we are in a position that all these issues must be confronted now. At this time , I can not reveal any further details of these particular instances we are confronting."

News Updates 02-04-03 ......

Representatives for Delusion have continued efforts in regards to the infringed use of the name Delusion. Several issues were discussed and several more issues were brought to their bands attention in regards to current use of the name. It seems there are currently several uses of the name that are infringements by similarity or likely to cause confusion with the trademark for the name Delusion. A plan of action is being executed to officially register the name Delusion with the USPTO to strengthen the mark and the music groups right of the already established common law trademark. A review of all conflicting uses is being undertaken in order to determine what infringements or confusions needs priority attention. More to come ......

Representatives for Delusion announce that there is a major epidemic of name infringement going on throughout the world and that six seperate cases of infringement are currently being pursued for the violation of this trademark.These infringements are currently under investigation and many people are being asked to remove their infringing content and post acceptable retractions to alleviate any confusions that have or may be caused.

News Updates 01-22-03 ......

Delusion have returned to the studio to complete mixing of the song I'll Fly" for the bands first music video. Mixing which began back in the fall of 2002 was temporarily delayed during the initial mixes when mixing engineer Drew Mazurek moved his operations to a newly built studio called Highview Studios. This delay caused a five month hold on the mixing sessions which have again resumed at the newly opened Highview Studios. The band will be wrapping the mixes for the song "I'll Fly" the last week of January. The music video which will be released a few months before the album release hits the streets. News Updates 01-01-03 ......

Delusion have finished production of their first music video with InFlight Video Productions. The video is currently in post-production and will be released March 1 , 2003. The band worked with InFlight Video for six months to put together not only the music video but a whole fourteen minute video presentation that includes a brief biography and short making of presentation. The video was filmed more like a movie than a music video. Inspired by scenes from a yet to be filmed movie that InFlight Video producers have been writing. It was a very creative video that captured nearly every aspect of production from costumes , makeup , movie sets , props , pyrotechnic effects , digital effects , animations , etc. More discussion on the video will be found here after its release on March 1st. News Updates 12-01-02 ......

Delusion continue to dominate the Mpulse Internet Music Charts with a still running 142 weeks straight in the Top 10 Hard Rock and Metal songs. The bands rendition of the Iron Maiden song "22 Acacia Avenue" for the tribute album Children of the Damned : A Tribute to Iron Maiden has been an unexpected favorite of the internet world and has succeeded in being what may be the longest running song to dominate the Mpulse Internet Charts. Delusion began its history on the Mpulse Internet Charts back in 1998 when they charted with their song "Feel This Way" which was released as a single for the compilation cd "Powermad '98 Festival Compilation CD. The band was then awarded with the honor of "Top 10 Hard Rock and Metal Song Of All Time" for the song " Feel This Way" in 2000. It was just after this that the song "22 Acacia Avenue" made its way into the Top 10 on the Hard Rock and Metal chart where it has been dominate for the past 142 weeks.
